1. General Provisions

By placing an order, customers acknowledge that they have read these Terms of Sale and the applicable Shipping Policy and Refund & Return Policy.
These Terms apply to purchases made by consumers and business customers, subject to the mandatory legal provisions applicable to each category.
Nothing in these Terms excludes, restricts, or overrides consumer rights that cannot lawfully be waived.
The Seller's legally required identification and contact information is made available on the Website and during the purchasing process.
2. Products and Availability
The Pink Lemonade offers a selection of design objects, collectible products, limited edition items, artworks, accessories, and other products described on the Website.
Each product is presented with relevant information, including its main characteristics, price, and any applicable production or availability conditions.
Product images are intended to represent the items as accurately as reasonably possible. Minor differences in appearance, color, or finish may occur due to screen settings, materials, and manufacturing characteristics.
Any material differences affecting the product's conformity with its description remain subject to applicable consumer protection laws.
Products are offered subject to availability.
If a product becomes unavailable after an order has been placed, we will contact the customer and offer the remedies required by applicable law, including a refund where appropriate.
3. Limited Edition Products

Limited Edition Products — No Voluntary Returns
The Pink Lemonade does not offer voluntary or discretionary returns for limited edition products beyond any mandatory statutory rights.
The limited edition status of a product does not, by itself, exclude a consumer's statutory right of withdrawal.
Where applicable law grants a right of withdrawal, that right remains fully enforceable.
Products manufactured according to the customer's individual specifications or clearly personalized may be excluded from statutory withdrawal rights where the legal conditions for such an exception are satisfied.
Any applicable withdrawal exclusion will be clearly communicated before the purchase is completed.
Nothing in this section limits statutory rights concerning defective or non-conforming goods.
4. Prices and Currency
All product prices are displayed on the Website in the currency indicated during the purchasing process.
Prices may vary depending on the destination, applicable taxes, currency settings, or other disclosed pricing conditions.
The total amount payable to The Pink Lemonade, including applicable product taxes and shipping charges, is displayed before the order is submitted.
Prices may be modified at any time before an order is accepted. Changes do not affect orders already accepted, except where otherwise required or permitted by law.
Customs duties, destination-country import taxes, customs clearance fees, and related import charges for deliveries outside the European Union are never included in our product prices or shipping fees.
These charges are payable separately by the customer where applicable.
5. VAT and Applicable Taxes
For orders delivered within the European Union, applicable VAT is calculated and displayed in accordance with the relevant tax regulations.
For orders delivered outside the European Union, the applicable VAT treatment depends on the relevant export and tax regulations.
Any destination-country import VAT, customs duties, customs clearance fees, or related import charges are excluded from the prices and shipping fees charged by The Pink Lemonade.

Any tax exemption or special treatment is subject to applicable legal requirements.
6. Placing an Order
Customers may place orders through the Website by selecting the desired products and completing the checkout process.
Before submitting an order, customers have the opportunity to review the products selected, quantities, shipping information, and total amount payable.
By submitting an order through the designated payment confirmation process, the customer acknowledges that the order entails an obligation to pay.

An order acknowledgment does not necessarily constitute acceptance of the order.
The sales contract is concluded when the Seller communicates acceptance of the order, including through an order confirmation, unless the checkout process expressly provides otherwise.
The Seller reserves the right to reject an order before contractual acceptance for legitimate reasons, including product unavailability, suspected fraud, payment authorization failure, or an obvious pricing error.
Any payment collected for an order that is not accepted will be refunded without undue delay.
7. Payment Methods

Available payment methods may vary depending on the customer's country, currency, or payment provider.
Orders are processed after the applicable payment authorization or confirmation has been received.
The Pink Lemonade does not assume responsibility for charges independently imposed by the customer's bank or payment provider, such as foreign exchange or international transaction fees, except where applicable law provides otherwise.
Payment information is processed through the relevant payment service providers in accordance with applicable security and data protection requirements.
8. Order Processing and Production
Orders are generally prepared for shipment within 2–4 weeks, unless a different timeframe is expressly specified on the product page or at checkout.
Limited edition products may require additional production, authentication, inspection, or preparation time following their release.
Any specific dispatch or delivery timeframe agreed with the customer will form part of the applicable contractual conditions.
Processing and production estimates do not eliminate the customer's statutory rights in the event of delayed or failed delivery.
9. Shipping Origin and Delivery
All orders are shipped from our warehouse in Italy.
The Pink Lemonade uses selected international shipping partners, including GLS, FedEx, DHL, and other specialized couriers.
Shipping charges are calculated based on the destination, size, weight, and characteristics of the purchased products and are displayed at checkout.
After dispatch, delivery generally takes approximately 3–7 business days, depending on the destination.
Delivery estimates may be affected by customs procedures, courier operations, and other circumstances outside our direct control.
The Seller will comply with applicable legal delivery obligations.
Where no different delivery period has been expressly agreed, the statutory delivery rules apply.
If delivery is delayed beyond an applicable contractual or statutory deadline, the customer may exercise the remedies provided by law.

10. International Orders and Customs Duties
All international orders are dispatched from Italy.
For deliveries outside the European Union, the customer is responsible for all applicable customs duties, import taxes, customs clearance charges, brokerage fees, and other import-related expenses imposed by the destination country.
These charges:

The Pink Lemonade does not pay, advance, collect, or reimburse destination-country customs duties or import taxes, except where mandatory applicable law requires otherwise.
Customers are responsible for checking their country's customs requirements before purchasing.
The Pink Lemonade cannot guarantee the amount of import charges that may be imposed.
All international shipments are accompanied by customs documentation prepared in accordance with applicable regulations.
We do not declare artificially reduced product values or incorrectly identify commercial shipments as gifts.
11. Refusal of Delivery and Unpaid Customs Charges
If a customer refuses delivery, fails to pay applicable customs duties or import taxes, or does not complete the necessary customs clearance procedures, the shipment may be delayed, held, returned to the sender, or otherwise handled by the courier or customs authorities.
Refusing delivery does not automatically constitute a valid exercise of the statutory right of withdrawal or create an unconditional entitlement to a full refund.
Where refusal is attributable to the customer and does not result from a failure by The Pink Lemonade to comply with its contractual or legal obligations, reasonable and documented additional expenses directly resulting from that refusal may be recoverable to the extent permitted by applicable law.
Such expenses may include:

Other reasonable and documented costs directly caused by the refused delivery.

Depending on the circumstances, these expenses may substantially reduce the refundable amount and, where legally permissible, may exceed the amount otherwise refundable.
No deduction will be made in violation of mandatory statutory withdrawal rights, refund obligations, or other consumer protection laws.
Each case will be assessed individually, taking into account the reason for the refusal and the applicable legal requirements.
Customers are strongly encouraged to verify import charges before ordering and to complete the required customs procedures to avoid unnecessary expenses.
12. Shipping Risk and Responsibility
The Pink Lemonade takes reasonable precautions to ensure that products are appropriately packaged and protected during transportation.
For consumer purchases, the risk of loss or damage generally remains with the Seller until the consumer, or a third party designated by the consumer other than the carrier, obtains physical possession of the goods, subject to applicable statutory exceptions.
Where a consumer independently commissions a carrier not offered by the Seller, the applicable statutory rules governing transfer of risk will apply.

13. Order Cancellations and Modifications
Customers wishing to modify an order should contact us as soon as possible after purchase.
We recommend submitting modification requests within 24 hours because production or preparation may begin shortly after an order is confirmed.
Requests to change product specifications, quantities, or shipping information cannot be guaranteed once processing has begun.
The 24-hour period applies only to operational modification requests and does not limit any statutory right of withdrawal.
Where the statutory right of withdrawal applies, the customer may exercise that right within the legally prescribed period, including before delivery.
For products lawfully excluded from withdrawal, cancellation requests will be assessed in accordance with the applicable contractual terms and mandatory law.
14. Statutory Right of Withdrawal
Consumers entitled to withdrawal rights under applicable Italian and European consumer protection laws may withdraw from an online purchase within 14 calendar days without providing a reason, subject to statutory exceptions.
The withdrawal period generally begins when the consumer, or a designated third party other than the carrier, physically receives the goods.
For orders delivered in multiple separate shipments, the period generally begins upon receipt of the last item.
To exercise the right of withdrawal, the customer must communicate an unequivocal decision to withdraw before the applicable deadline.

After communicating withdrawal, customers must return the goods without undue delay and within 14 calendar days, unless applicable law provides otherwise.
Direct return shipping costs are borne by the customer where permitted by law and where this responsibility was disclosed before purchase.
For a valid statutory withdrawal, the Seller will reimburse the payments required by law, including eligible standard delivery costs.
Refunds will be made without undue delay and no later than 14 calendar days after the Seller is informed of the withdrawal decision.
Where permitted by law, reimbursement may be withheld until the returned goods have been received or the customer has provided evidence of having sent them back, whichever occurs first.

15. Exceptions to the Right of Withdrawal
The statutory right of withdrawal may not apply to certain categories of goods expressly excluded under applicable law.
These may include goods made to the consumer's specifications or clearly personalized, where the relevant legal conditions are satisfied.
Limited edition status, restricted availability, numbering, authentication, or production following a product launch does not automatically remove statutory withdrawal rights.
Any applicable exception will be disclosed before the order is completed.
The Pink Lemonade does not provide additional voluntary or discretionary returns for limited edition products.
Nothing in this section affects statutory rights concerning defective or non-conforming products.
16. Refunds and Returns
Returns and refunds are governed by our Refund & Return Policy and applicable consumer protection laws.
For valid statutory withdrawals, refunds will be calculated according to the relevant legal requirements.
The Seller does not impose arbitrary restocking fees, administrative penalties, or general handling charges merely for exercising a statutory right of withdrawal.
Customers may be responsible for diminished product value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods, where permitted by law.
Return shipping expenses may be borne by the customer in the circumstances permitted by applicable law.
Products that are defective, incorrect, or non-conforming will be handled in accordance with the applicable statutory remedies.
17. Legal Guarantee and Product Conformity
Products sold to consumers are covered by the applicable statutory legal guarantee of conformity.
Under Italian consumer protection law, the statutory guarantee for new consumer goods generally covers defects of conformity that become apparent within two years of delivery, subject to the relevant legal requirements.
Where a product is defective or non-conforming, the customer may be entitled to repair, replacement, an appropriate price reduction, or termination of the contract with a refund, according to the applicable statutory conditions.
The Seller will bear the costs of legally required remedies.
The legal guarantee applies to eligible limited edition products and other goods sold through the Website.
Any commercial warranty offered in addition to the statutory guarantee will not replace or restrict mandatory consumer rights.

Purchasing a physical product does not transfer copyright, trademark rights, reproduction rights, or other intellectual property rights associated with the product.

20. Limitation of Liability
The Pink Lemonade is responsible for fulfilling its contractual and statutory obligations in accordance with applicable law.
To the maximum extent permitted by law, the Seller will not be liable for losses arising solely from circumstances outside its reasonable control where no contractual or statutory liability applies.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from intentional misconduct, gross negligence, or mandatory consumer protection obligations.
The Seller does not exclude responsibility for delivery failures, defective products, or other breaches where applicable law imposes liability.
21. Events Beyond Reasonable Control
Circumstances outside the Seller's reasonable control may affect production, shipping, or delivery.
Such circumstances may include natural disasters, major transport disruptions, governmental restrictions, or other extraordinary events.
Where these circumstances affect an order, The Pink Lemonade will inform the customer where reasonably possible and take appropriate steps to address the situation.
These events do not automatically extinguish the customer's statutory rights or the Seller's obligations under applicable law.

Nothing in these Terms restricts a consumer's right to bring proceedings before a court having mandatory jurisdiction under applicable consumer protection rules.
For business customers, jurisdiction will be determined in accordance with applicable law and any validly agreed contractual provisions.
